A Magistrate’s Court in Abuja orders the FCT-IRS to seal a company’s premises for failure to file annual returns

A Magistrate’s Court in Abuja has instructed the FCT Internal Revenue Service (FCT-IRS) to seal a company’s premises due to its failure to file annual returns.
Magistrate Janada Balami, on Friday, deemed the FCT-IRS’s application against Ifedi A.K. Nigeria Ltd justified and granted the request to seal the company’s premises at No 6 Rudolph Close off Katsina-Ala Street, Maitama, Abuja.
During the hearing, Michael Towolawi, counsel to the FCT-IRS, informed the court that the company had neglected to submit its annual returns from 2019 to 2023. Despite attempts to compel compliance, the company remained non-responsive, contravening Section 81 of the Personal Income Tax Act, LFN, 2004, amended in 2011.
Festus Tsavsav, the Director Legal of the FCT-IRS, told journalists after the session that the service would take action against companies that fail to file annual returns as mandated by law.
Tsavsav remarked, “With the FCT’s new minister spearheading numerous projects, funding is crucial. Since FCT is no longer under TSA, internally generated revenue will facilitate the timely completion of these projects.”
The case has been adjourned until May 16 for further proceedings.
