Court sacks Onifiditi of Fiditi

An Oyo State High Court, sitting in Ibadan, has granted an order of mandatory injunction setting aside the selection and appointment of Onifiditi of Fiditi, Oba Oyeleye Oyewole Sakirudeen.

The suit marked IHOY/59/2013, was between the applicants, namely Prince Samuel Bolatito Ogunkunle and Bayo Oyewale and Oba Oyelere Oyewole Sakirudeen, Prince Ademola Akande, Prince Depo Oguntoyin, Prince Kunle Oniyitan, who are 1st, 2nd, 3rd and 4th defendants respectively.

Others listed as defendants in the suit include the Oyo State governor (5th) Commissioner for Justice (6th), Commissioner for Local Government and Chieftaincy Matters (7th), and Chief Adebola (8th).

Earlier during the proceeding on 1st of February, 2024, R. A. Olawuwo and B.M. Olimene appeared for the claimants, while P.O Alamu was the counsel for the 1st, 2nd, 3rd, and 8th defendants. O.A. Okeyinka appeared for the 4th defendant, just as N.A. Abiola was the counsel for 5th, 6th, and 7th defendants.

Delivering his judgment, Justice K.B Olawoyin declared that “An order of mandatory injunction is hereby made/granted setting aside the presentation of staff of office to the 1st defendant as the Onifiditi of Fiditi on October 18, 2021, by the 5th, 6th, and 7th defendants.

According to a certified true copy of the judgment obtained by the Nigerian Tribune, on Tuesday, the judge also granted “an order of interlocutory injunction restraining the defendants jointly and/ or severally by themselves, their servants, agents and/ privies from taking any further actions, steps or proceedings towards or in pursuance of filling of the vacant stool of Onifiditi of Fiditi pending the determination of this suit. 

Justice Olawoyin also awarded a cost of N200,000 in favour of the applicants against the 1st to 3rd and 8th defendants. 

He subsequently adjourned the suit to May 22, 2024.
